Terms and Conditions

These Terms govern your use of the Lovecraft mobile application and lovecraft.com, operated by SyncIRL LLC ("Lovecraft," "we," "us," or "our"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use Lovecraft.

1. Eligibility

You must be at least 18 years old to use Lovecraft. By creating an account you represent that you are 18 or older and have the legal capacity to enter into these Terms. We remove accounts we believe belong to minors.

2. Your account

• Provide accurate information, including your real age and photos that are actually of you.
• Phone verification is required at signup. It is a one-time security step that confirms your number belongs to you, and it does not sign you up for any text message program. See Section 6.
• You are responsible for your account credentials and for activity under your account.
• One account per person. Do not impersonate anyone, create duplicate accounts, or transfer your account to someone else.
• We may suspend or terminate accounts that violate these Terms.

3. What Lovecraft does

Lovecraft is activity-first dating. Instead of presenting you a profile to judge, we present a plan: an activity, a time, and a person. Where a specific venue is involved, its location is revealed only once both people confirm.

We introduce people and help arrange plans. We do not vet, endorse, or supervise the people you meet. Any meeting you attend is your own decision and your own responsibility.

4. Bookings, tickets, and payments

• Payments are processed by Stripe, Inc. By paying, you also agree to Stripe's terms.
• Prices are shown before you confirm and include applicable fees at checkout.
• Where a plan requires a ticket, reservation, or paid activity, confirming the plan is a commitment to pay. We will tell you the amount before you confirm.
• Refund eligibility depends on the venue and the activity. Requests must be made before the scheduled time. We may decline refunds for activities that already occurred.
• We are not responsible for cancellations, closures, or changes made by a venue or organizer. Where a venue cancels, we will help arrange a refund where possible.

5. Safety

Use the block and report tools if someone behaves badly. Blocking is mutual and silent. We review reports and act on them, including removing accounts. If you are in immediate danger, contact local emergency services first.

6. SMS communications

SMS consent is never a condition of using Lovecraft. Agreeing to these Terms does not opt you in to any text message program. Creating an account, verifying your phone number, matching, and confirming a plan never require you to consent to receive text messages. You can decline text messages and still use every part of the service.

One-time verification codes. When you choose to verify your phone number, we send a single one-time passcode to the number you entered so we can confirm it belongs to you. It is sent only in response to your own request, it is not a recurring message program, and it is not marketing.

Lovecraft does not send marketing or promotional text messages. For help with any message, contact support@lovecraft.com.

7. Conduct

You agree not to:

• Harass, threaten, stalk, intimidate, or harm anyone.
• Misrepresent your age, identity, or photos.
• Send sexually explicit content to anyone who has not asked for it, or any sexual content involving minors, which we report to authorities.
• Use Lovecraft for commercial solicitation, advertising, sex work, or recruiting.
• Solicit money, financial information, or gifts from other users. Romance scams result in immediate removal.
• Copy, scrape, or redistribute other users' photos or information.
• Use bots, scrapers, or automated access, or attempt to reverse-engineer or disrupt the service.
• Use Lovecraft for any unlawful purpose.

8. Your content

You keep ownership of the photos and text you post. You grant us a non-exclusive, worldwide, royalty-free license to host, store, and display that content solely to operate Lovecraft. This license ends when you delete the content or your account, except where we must retain it for a safety report or a legal obligation.

Do not post content you do not have the right to post. We may remove content that violates these Terms.

9. Intellectual property

The Lovecraft name, logo, design, and all related content, features, and functionality are owned by SyncIRL LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app or its content without our prior written consent.

10. Third-party services

Lovecraft integrates with and may link to third-party services, including payment processors, venues and booking platforms, and map providers. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the actions, content, or practices of any third-party service.

11. Disclaimers

Lovecraft is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, that any venue or activity information is accurate, or that you will meet anyone or have any particular experience.

We are not responsible for the conduct of any user, online or in person.

12. Limitation of liability

To the maximum extent permitted by law, SyncIRL LLC and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Lovecraft, including loss of profits, data, or goodwill; personal injury or property damage resulting from interactions with other users or attendance at any meeting or activity; cancellations or changes by a venue; or unauthorized access to your account.

Our total liability for any claim relating to these Terms or the service is limited to the greater of the amount you paid us in the twelve months preceding the claim, or one hundred US dollars.

Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless SyncIRL LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of Lovecraft, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may delete your account at any time by contacting support@lovecraft.com. We may suspend or terminate your account at any time if you violate these Terms or if we believe it is necessary to protect other users. Upon termination, your right to use Lovecraft ceases immediately. Where a paid plan is already confirmed at the time of termination, Section 4 governs any refund. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive.

15. Changes to these Terms

We may update these Terms. If a change is material, we will notify you in the app or by email before it takes effect. Continuing to use Lovecraft after a change means you accept the updated Terms. If you do not agree to a change, stop using the app. The effective date at the top always reflects the current version.

16. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any dispute arising from these Terms or from Lovecraft shall be resolved in the state or federal courts located in Hennepin County, Minnesota, and you consent to that jurisdiction.

17. Dispute resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@syncirl.com. If the dispute cannot be resolved within 30 days, either party may pursue formal resolution in accordance with the Governing Law section above.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SyncIRL LLC regarding your use of Lovecraft.
